The Independent Care Act Advocacy Service is for people who have substantial difficulty in representing themselves through the Local Authority’s care and support processes. If they have no-one who is appropriate to support and represent them, an advocate from our team will empower them to be as involved as possible. The service aim is for people’s wishes, feelings and needs to be at the heart of the assessment, care planning and review processes; and to maximise their understanding and involvement in any Safeguarding Enquiry or Safeguarding Adult Review. The service is free to access and is independent from all other services.

The service provides independent advocacy support for people who have been assessed to lack the capacity to make specific decisions and have no one appropriate for the decision makers to consult with. The advocacy involves ascertaining clients’ wishes, feelings, beliefs, and values relating to decisions on serious medical treatment, changes of accommodation, during the care review processes or Adult Safeguarding processes. The advocates are independent of the person making the decision and will represent the client within meetings and discussions, submitting a report which raises considerations which the decision maker should take in to account. The advocate will question and challenge any decision that appears not to be in the client’s best interest. This service is free to access and independent of all other services.

In the community:The IMHA service will work with qualifying patients who are under Supervised Community Treatment (CTOs) and live within the Barnsley Metropolitan Council Local Authority boundaries. In hospital and secure settings:We will work with any patient who is detained under the Mental Health Act (qualifying sections) within the Barnsley Metropolitan Council Local Authority area. This includes qualifying patients who are placed in hospitals or other secure settings within the Barnsley boundaries, but do not otherwise live in the area. The advocates will work with the clients to ensure that they understand their rights, understand any treatments being discussed and have a say in discussions about their care. If the patient has been assessed as lacking capacity to instruct an advocate, we will use Non-instructed Advocacy to ensure that the client is still at the centre of all care planning and decisions. The service is free to access and is independent from all other services
